Sweden Car Accident Claim: Whiplash Fracture Dislocation Concussion Back Disc Hernia

Wednesday, February 20th, 2013

UK solicitor sets out how to claim from the UK if you have been involved in a car accident in Sweden suffering injuries such as a fractured wrist, dislocated finger, whiplash neck injury, lower back disc hernia, fractured knee patella and concussion

Sweden road traffic accident victim question

I was a front seat passenger in a hire car driven by my wife. We are both reside in England and had visited some family in Helsinki in Finland, we flew to Sweden and hired a car to drive in Stockholm with a view to travelling to Gothenburg.

We were waiting at a junction in  Stockholm when we were hit from behind by a van.

My wife speaks Swedish and at the accident scene the police attended and the van driver completed a police report form saying “Förlåt mig. Det var mitt fel”.

My wife tells me that this is an acceptance of liability as it means something to the effect of “Sorry, my fault.” This was pretty much confirmed by the Swedish police when we contacted them after the accident.

An ambulance attended at the scene and we were taken to a hospital in Stockholm and I was diagnosed with a fractured wrist, a dislocated index finger at the knuckle and whiplash to my neck. My wife was diagnosed with concussion, a fractured patella in her knee, whiplash to her neck and a lower back disc herniation.

We are now back in Ipswich in England and still receiving treatment for our injuries and would like to make a claim for compensation. How do we go about this?

European road traffic accident solicitor response

As your car accident occurred in Sweden, which is a member of the EU, both you and your wife can commence a claim for compensation for your injuries (fractured wrist, dislocated finger, whiplash, fractured patella, lower back disc hernia, fractured knee patella and concussion) from the UK.

In addition there might be a psychological element to your injuries, such as post-traumatic stress disorder, which should not be overlooked.

You will need a specialist European road accident solicitor to help you make your claim – there are very few with the expertise in the UK.

Torremolinos Car Accident Claim UK: Malaga Marbella Granada Seville

Friday, August 24th, 2012

European road traffic accident solicitor sets out how to claim compensation for a car accident in Spain – includes  Torremolinos, Malaga, Marbella, Granada, Seville and all other areas of Spain

Car accident victim question (Torremolinos / Malaga Spain)

My wife and I took a package holiday to Malaga. In Malaga and separate from the package we hired a car to drive around the area and visit Granada, Torremolinos, Marbella and Seville.

In Torremolinos we were waiting at a set of traffic lights when a car collided with great force to the rear of our car. The back of the car was badly damaged and my wife and I were thrown forward with great force.

Thankfully – we were wearing seatbelts. I did hit my head on the steering wheel and my wife hit her hand on the passenger door.

I got out of our car a little dazed and confronted the other driver – who was Spanish. He apologised and started to complete an accident report form when the police arrived.

A report was completed by the police and an ambulance was called. My wife and I were taken to hospital in Malaga, x-rays taken. I was found to have whiplash to my neck, thoracic back pain and concussion symptoms. My wife had a fractured index finger in her right hand, whiplash and lower back pain.

We are now back in England and still suffering from our injuries – can we claim compensation in the UK for our Torremolinos RTA?

Spanish road accident solicitor response

“Yes” – you can claim compensation in the UK for your injuries and expenses as a result of your road traffic accident in Torremolinos. This is despite the fact that the car was hired outside of the package holiday agreement.

Road accidents in European Union countries can be commenced in the country of the EU resident’s domicile – which for you is the UK.

You took all the correct steps by involving the Spanish police, completing an accident report at the scene and attending at the hospital in Malaga so I do not see too much a difficulty in proving liability of the Spanish driver.

The process of claiming compensation for a Spanish RTA is not as simple as an ordinary car accident in the UK. You will need the assistance of a specialist European road traffic accident solicitor.

Croatia Hotel Accident Package Holiday: Claim In The UK For Fractured Wrist Pelvis

Tuesday, January 31st, 2012

How to claim compensation in the UK for an injury in a hotel whilst on holiday in Croatia as part of a package holiday – includes a broken wrist and fractured pelvis

Croatian holiday accident victim question

I booked a holiday to Croatia with a travel agent in London, which included flight, hotel accommodation and transfers.

During the second week of my holiday I was in the hotel walking up the wooden steps when one of the steps gave way causing me to land badly on my hand and hip.

A member of the hotel staff witnessed my fall and came to my assistance calling first aid who applied ice. I initially believed I was badly bruised, but that night I was in agony and could not sleep.

The next day – my husband took me to the local hospital and I was diagnosed with a broken wrist and badly bruised pelvis.

We returned to the hotel and spoke to the manager. My husband made sure he made an entry into the accident book.

I have now returned home and have been to the hospital and been told that I have a simple undisplaced fracture and a hair line fracture of the pelvic bone.

As the accident happened in Croatia – am I still able to make a claim for my injured wrist and pelvis?

Holiday accident solicitor response

As you booked the holiday with a travel agent in the UK who arranged both flight and accommodation – your holiday is considered a package holiday and as such you can make a claim from the UK against the London travel agent.

This will allow both the Law of England and Wales and Croatian law to be considered, but on the question of liability of fault UK the hotel can be expected to have standards similar to England and Wales.

From the description you have given – it appears to me that the hotel and so the travel company were at fault for having a defective step in the hotel.

Your injuries will need to be properly assessed by a medical expert instructed by a specialist holiday accident solicitor – who will look at your GP and hospital notes and examine you to determine the exact nature of your broken wrist and fractured pelvis.

Based upon this medical evidence your solicitor can value your claim for pain and suffering. Additional evidence will be necessary to describe any financial losses you have suffered, which might include loss of enjoyment of holiday, medical expenses, etc.
