Any claim for damage should be made against the person who caused the accident.
If that person was mentally ill – it is likely he was being supervised at the time of the accident and so the body responsible for his supervision might also have a liability.
Any insurance in place will be used to indemnify the persons you claim against.
I suggest you check on your motor policy to see if you have legal protection cover and use that cover to pay for a lawyer to make the claim on your behalf.
