Find out how to claim compensation for a skiing accident in France when the injury occurred during a package holiday
Parents of ski accident victim
My family and I were on a skiing holiday in France which was a package holiday arranged in England and included flights, accommodation, ski lift passes and some private lessons for our daughter, aged 10.
When she was using the ski lift for the first time during a lesson she jumped off too soon falling a distance and resulting in a damaged knee and torn ligaments. She now requires re-constructive surgery to her cruciate ligaments.
Can we claim for our daughter’s injuries?
Sports injury solicitor response
It seems that the instructor giving the lesson was not properly supervising your daughter. The protective barrier on the lift must have been raised too soon and your daughter should not have been allowed to try to leave the lift until it was safe.
As your holiday was arranged, including the ski lessons, as part of a package holiday it would seem in addition to a claim against the resort and the instructor your daughter would have a claim from the travel company which you booked your holiday with under the Package Holiday Regulations.
I imagine that you also had suitable travel insurance to include winter sports which is likely to have legal protection cover to fund the costs of solicitor should a claim be necessary.
