Can I Claim Compensation For Damage Caused By Tree Falling On My Car?
A tree fell on my car a few weeks ago. However, my insurance said it will need to go through my policy as it will only be a no fault if the other party admits they knew the tree was rotten. This has left me out of pocket, paying the excess, getting the bus to work and losing my No Claims Bonus.
Am I able to claim for these losses through Motor Legal Protection?
Compensation Claims Solicitor Response
Although your insurer may not be prepared to attempt to recover its outlay from the owner of the tree – if you have the benefit of legal protection cover I recommend you attempt to use this cover to claim against the owner of the tree.
It may turn out that there is no claim, but is worth using your cover to fund this investigation. The householder will be covered by buildings and contents insurance should liability be found.
As part of your claim you should also have your excess refunded and your no claims bonus reinstated.
